| Selecting a Commercial Real Estate Lawyer
| How to Find One: Speak to family, friends, other professionals such as real estate brokers, accountants, appraisers and other who are in regular contact and interaction with real estate lawyers. The internet is a great resource and many legal directories can be found through the available search engines.
2.Experience: You should decide how much experience you are looking for in a lawyer. If the transaction is fairly simple you may elect to hire a sole practitioner or one with less experience and this may reduce the legal expense in closing the transaction.
3.Specialty: Do they only do commercial real estate law? Do they specialize in the type of real estate work that you require services for? Example – If you are involved in negotiating an office lease, do they specialize in this type of documentation and negotiation.
4.Location: Are they accessible to you, in a location that you can easily get to, depending on your mode of transportation.
5.Culture: Do they understand your culture and style of doing business. There may be superstitions that they should be made aware of. This may affect the parties to the transaction.
6.Complaints: Do they currently have any pending actions or complaints against them? Can always contact the Law Society to check this out.
7.References: Obtain references and call them.
8.Closings: How many closings do they do in a typical month? What is their busiest day?
9.Availability: How available are they in the event you need them? Do they carry a Blackberry device? How quickly do they return emails, phone calls, faxes, etc. Do you eventually deal through an assistant or paralegal. Are they a front guy and you deal with the back office.
10.Price & Services: How is their price structured? Can you obtain a fixed price? What extras do they bill for? Do they require a retainer? What services are offered and on what basis? |
